You also understand and agree that the Service may include certain communications from UltimateWebTraffic.com, such as service announcements and administrative messages, and that, should you become a member of UltimateWebTraffic.com at any time, these communications are considered part of UltimateWebTraffic.com membership. 8. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, or hardware, or telecommunications equipment;
9. disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other Service users’ ability to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges;
10. interfere with or disrupt the Service, servers, or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
11. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
12. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
13. “stalk” or otherwise harass others; and/or
14. collect or store personal data about other users in connection with the prohibited conduct and activities set forth above in paragraphs “a” through “m”.

You acknowledge that UltimateWebTraffic.com may or may not pre-screen Content, but that UltimateWebTraffic.com and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or remove any Content that is available via the Service. Without limiting the foregoing, UltimateWebTraffic.com and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. 13. Duplication

14. Use and Storage Practice

You acknowledge that UltimateWebTraffic.com may establish general practices and limits concerning use of the Service, including, without limitation, the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on UltimateWebTraffic’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. Termination of your access to the Service account includes (a) removal of access to all offerings within the Service, including but not limited to UltimateWebTraffic.com paid and free products, services, communication, assistance, and all other access, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. 20. Disclaimer of Warranty

22. Limitation and Exclusion

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of Sections 19 and 20 may not apply to you.

Without UltimateWebTraffic’s prior permission, you agree not to display or use the UltimateWebTraffic Marks in any manner.

27. Copyright Claims

UltimateWebTraffic.com respects the intellectual property of others, and we ask our users to do the same. UltimateWebTraffic.com may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts and access to the Service of users who may be repeat infringers. 29. Choice of Law and Forum

The TOS and the relationship between you and UltimateWebTraffic.com shall be governed by the laws of Netherlands without regard to its conflict of law provisions. You and UltimateWebTraffic.com agree to submit to the personal and exclusive jurisdiction of the courts of Netherlands.

30. Waiver and Severability of Terms

The failure of UltimateWebTraffic.com to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties, nevertheless, agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

31. No Right of Survivorship and Non-Transferability

You agree that your UltimateWebTraffic.com account and access to the Service is non-transferable and any rights to your UltimateWebTraffic.com membership or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

32. Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, or related to use of the Service, or the TOS must be filed within one (1) year after such a claim or cause of action arises or it will be barred forever.

34. Purchase Agreement

Procurement of any paid product or service provided by UltimateWebTraffic.com is subject to the terms and conditions set out in our Purchase Agreement. You understand that by committing to acquire any form of product or service provided by UltimateWebTraffic.com , which is provided to you in exchange for monetary or financial compensation, you are agreeing to all of the policies, terms, conditions and statements made in our TOS, as well as those in the Purchase Agreement.

36. Monthly Subscription

In case of cancellation, there will be a pro rata refund (partial refund based on the proportion of the product or service used).

37. Refund Policy

The only time a client is eligible for a refund is if the order was not completely fulfilled as determined by our system link setup. Refunds will not be offered based on unrecommended trackers. A client can choose to have more cheap traffic sent to fill the order or be refunded for the traffic not sent. The request will be respected within seven days after the delivery completion date has passed. Past that, no refund will be granted.

For our Traffic Wizard, we will only refund unspent funds. Funds that have been spent, will not be refunded.

If your site is changed during the campaign such that it includes inappropriate content as mentioned in our terms and service, UltimateWebTraffic.com will stop your campaign immediately. In this case, you WILL NOT be entitled to a refund.

In cases where refunds are claimed for incomplete traffic, we reserve the right to require proof that the proper number of visitors were not delivered. Stats, Data and other information from third party counters (e.g. Extreme-DM.com, Hitbox, etc) are not sufficient to establish a claim. These counting systems tend to yield an improper count. If we dispute your claim, you must provide us with RAW server logs from the site and time period in question – this is the only reliable method of counting a visitor.

As mentioned in our FAQ, we can not guarantee our Alexa traffic will increase your Alexa ranking. Alexa rankings are based on more than just traffic. So we do not offer refunds for our Alexa traffic based on a lack of increased rankings. A refund would only be offered if we can determine our system did not send the traffic.

Please note, we do not have a bitcoin wallet, we use a third party to process bitcoins, which sells the bitcoins right away. So we are unable to refund via bitcoins.

All refund requests should be made within 30 days of placing a campaign order on our website. All requests made after this period will be rejected.

All refunds will be made either to the original payment method, or any other method of choice by the client. Please note that the refund account details (Name, Address or any other relevant information), should match with your account/personal details.

We do not take responsibility for any client local bank charges, commissions or any deductions incurred after a refund. The responsibility solely lies on the client.

 38. Signups / Sales / Conversions

We do not guarantee a client will receive sales / signups / conversions from the website traffic we send. Our only guarantee is that we will send the traffic our client ordered. So, if nothing comes from the traffic sent, we are held blameless and will not issue a refund.

While it is possible, we also can not guarantee earnings through Adsense or other advertiser networks. Also, our Web Traffic, Mobile Traffic, and Expired domain traffic are not safe for adsense. Our Traffic Wizard and Popunder Traffic are safer, but we do not guarantee account safety.

39. Unavailability

Should a client’s website, for whatever reason, become unavailable, the client holds us blameless. Should the unavailability be from over-ordering (more traffic than client hosting can handle), the client is responsible for buying traffic . We have no knowledge of the hosting plan of a client so we cannot promise uptime. Any traffic delivered during the downtime is not refundable. It is the client’s responsibility to ensure that his or her website is in working order and to stop the traffic with the use of the provided c-panel if the website becomes unavailable.

40. Campaign Monitoring

Clients will be provided with a c-panel to track their traffic campaigns. We will also set up a lnk.direct, which will allow clients to get more detailed tracking information. If a client wishes to install a script for tracking on his or her website, we recommend using www.statcounter.com or www.extremetrac king.com . We do not recommend using Google Analytics, Awstats, and other similar 3rd party scripts. They are not accurate with our delivery method.

41. Mistakes When Ordering

The client is responsible for any mistakes made during the ordering process. If the client provides us the wrong URL, GEO, or niche in the beginning and notifies us of the error, we will gladly make the change. However, any traffic that was generated during the mistake will not warrant a refund. If a client happens to buy web traffic more than once by mistake, we can refund for the extra traffic or split the order up into various traffic campaigns (minimum being 5,000 visitors). However, once the campaign has been set up, we cannot split the traffic or offer a refund for the extra traffic.

42. Delivery Speed

After a client places an order, we manually set up his or her c-panel and web traffic campaign. Once this has been completed, an email containing the login information will be sent to the client. Typically, this happens within 12 hours, however emails are only sent out during our office hours as listed on our Contact Page. The campaign will then become active after our tech team has approved the landing page. Most traffic campaigns are activated within 24 hours after ordering. However, Pop-under, Adult, and Alexa traffic campaigns are not activated on weekends.

All new client orders will have a delivery speed of at least 5 days set. Due to the nature of our business and the risk of fraudulent orders, we have this policy in place to protect ourselves. Once we have established a positive history with a client, delivery speed can be set for under 5 days. Since we only send real traffic, we cannot guarantee the delivery speed. In some GEO / Niche target combinations we do not have the inventory to deliver at a high daily volume.

Pop-under orders with auto playing videos or sound will run slower since we only allow these types of websites on a small percentage of our pop-under network. Pop-under orders with pop-ups / javascript prompts are capped at 1,000 visitors per day.

43. Websites That Are Not Accepted

Any website / URL that has any of the following is not permitted:

• Websites with illegal, racist, or hateful content.
• Websites with content we deem to be inappropriate for our visitors.
• Phishing URLs, Trojans, Adwares, Malware, etc.
• Iframes that redirect to malicious websites.
• Frame breaking scripts.
• Websites with download prompts.
• Popups or Javascript Prompts (1 allowed on Pop-Up Traffic).
• No Stumble Upon Links.
• Adf.ly, Adfoc.us, and other PTP sites.
• Sites with clicksor ads.
• Blank landing pages.
• We do not deliver to: Facebook, Youtube, Twitter, and other Social media sites. For social media services, go to EasySocials.com.

Should any of these be added to the website after its approval, the campaign will cease immediately and the client will not be refunded for his traffic purchase. Furthermore, if we discover you are trying to get around our ToS a refund will also not be granted.

We also hold the right to refuse service to anyone we choose. A refund will be provided if we refuse service.

Purchase Agreement

All the orders processed through UltimateWebTraffic.com are subject to the conditions found on the Terms of Service page, as well as those in the following Service Agreement.

By placing an order, it is understood that you have read, understood, and agreed with the terms on both the Service Agreement page and the extended Terms of Service page. These terms and conditions are an agreement between you (“client”) and UltimateWebTraffic.com (“us”). They should be read and understood.

Orders can be canceled when we feel this is appropriate for the benefit of the company.

We reserve the right to refuse any order at will.

We are not responsible for specific outcomes of orders.

All orders are processed as soon as possible following the date ordered. This period usually spans between 24 to 72 hours, depending on the volume of the order(s). This timeframe excludes orders placed on weekends; these are processed on the next business day. Depending on the demand, the campaign process may take up to 72 hours to initiate.

All traffic services are provided as is. All campaigns are considered active the moment the first traffic activity is performed for your website.

All website traffic services will be delivered to the website link submitted with the order. In the event of an error in the submitted URL, the Client will not hold UltimateWebTraffic.com or its partner sites responsible for the error. Any service delivered to a Client’s website reflecting the above error will not be credited or entitled to a refund.

In terms of campaign start-date, due to variances in amounts of traffic services purchased at different times, the starting date may fluctuate. We are in no way to be held responsible if your campaign does not start receiving the traffic service by a specific date.

You are guaranteed that we will send the necessary website traffic activities to the URL during the period you have ordered. This is the only guarantee for this service. In no event shall we be liable for any consequential, direct, indirect, incidental, punitive, or other damages whatsoever. These include, but are not limited to, damages for loss of profits, loss of information or other pecuniary losses arising out of the use or inability to use the package. This is applicable even if we, the service provider, have been advised of the possibility of such damages.

If we are unable to deliver the necessary quantity or website traffic activities within 60 days of the campaign’s starting date, you may claim a refund. In the unlikely event that we, the service provider, do not deliver the number of visitors promised, we will provide a refund of your entire purchase price on a pro-rata basis. In cases where refunds are claimed, we reserve the right to further investigate and approve or decline your request. Refunds are issued at the sole discretion of UltimateWebTraffic.com.

In the event that the Client’s website becomes unavailable for any reason (“server is down or unavailable, timed out, or shows to be active but with internal server errors, 404 errors and other types of common or uncommon errors associated with the internet and its underlying infrastructure”), the Client will not hold UltimateWebTraffic.com or its partner sites responsible for these errors. All/any website traffic activities delivered to the Client’s website during this down-time will not be credited or refunded. In the event that any of the above errors occur, including any errors not listed, but clearly intended, the client may submit, in writing, a request for the campaign to be placed on hold. Upon resolution of the problem, the on-hold campaign will resume. Any website traffic activities previously performed will neither be credited nor refunded.

When you purchase a website traffic campaign, you understand and agree that the statistics system utilized by UltimateWebTraffic.com will serve as the official record of delivered results. UltimateWebTraffic.com will not be held responsible for website traffic activities not received on your web page but sent from our website traffic resources during down-time on any components on the Internet or on a client’s site for any reason. Note that any website traffic services delivered under these conditions will not be credited or refunded.

The Client understands that website traffic will not be immediately noticeable after traffic activities are initiated. It may take up to 48 hours for traffic to start flowing to your website, and this time will not be included in the monthly subscription timeframe. If the Client is subscribed to a monthly maintenance service, this service will start after the traffic campaign begins and will end one month from that date. The Client also understands that UltimateWebTraffic.com does not guarantee income from the increased website traffic and will not issue a refund if none is achieved. In other words, UltimateWebTraffic.com does not guarantee sales, nor will it be held responsible if none are generated. The only guarantee for this service is that we will deliver the agreed amount of website traffic.

The Client acknowledges that the order is for the stated term. These terms and conditions are subject to change at any time after the stated term has ended.

The Client may not sell, assign or transfer any of the rights or services accompanying the purchase. Any attempt, either by accident or design, undermining the intention of this T.O.C. or the general principles that it was written for, will result in immediate account deletion with no eligibility for refunds or adjustments.

In the event that there is a discrepancy between the website traffic recorded by UltimateWebTraffic.com and website traffic claimed by the Client, the Client agrees to use the statistics prepared by our (“UltimateWebTraffic”) campaign manager to be the official report. The Client understands and acknowledges the campaign report received by UltimateWebTraffic.com to be true and accurate, and agrees to hold UltimateWebTraffic.com , its parent company, as well as all companies and individuals involved, harmless for any unexpected results arising from any website traffic campaign.

The support staff is available virtually during business days and is ready to answer your questions. All requests must be made in writing via email or through phone. The Client also understands that technical support may not be available at the exact time in which the client initiates contact. It is our policy to respond to all emails within 24-48 hours. The Client agrees to these terms of service and understands that they are legally binding.

UltimateWebTraffic.com shall be permitted to identify a Client as a UltimateWebTraffic.com Client and may use the Client’s name in connection with UltimateWebTraffic.com marketing material. Subject to the prior approval of each party, UltimateWebTraffic.com may elect to issue a joint press release announcing the Client’s marketing partnership with UltimateWebTraffic.com .

UltimateWebTraffic.com will not promote spam, scam, hate, porn, warez, hacking, or any other site/offer that could be considered offensive to the most discriminated viewer. Any attempt to bypass our intended guidelines will result in account cancellation and no recourse to a refund.

UltimateWebTraffic.com will review your website before initiating a campaign. If your website is significantly changed during the campaign in such a way that negatively affects its ranking (metadata changes, low-quality images were used, website content was deleted, etc.) UltimateWebTraffic.com will not be liable for rank failure. In this case, you will not be provided a refund on a pro-rata basis.

UltimateWebTraffic.com cannot be held responsible for factors beyond our control that may interfere with our ability to improve the traffic of your website. Such factors include, but are not limited to, down-time on your website, errors on on your website, and changes on your website.

TERMINOLOGY: (1) “In the present context, a campaign is considered active if website traffic is being delivered to the client’s site. It is sufficient to observe the agreed amount of traffic being directed to the site to consider that the service was delivered.

(2) The “Monthly maintenance” subscription ensures that the agreed level of traffic will continue to be delivered to the client’s site for one month from the moment the traffic campaign begins.

(3) “Pro-rata” refunds are calculated by dividing the number of days the agreed level of traffic was delivered by 30 (the number of days included in the monthly maintenance subscription). The result of this calculation is subtracted from 1, and the resulting figure is multiplied by your purchase price to derive the “pro-rata” refund.”

If any provision of this Agreement is deemed invalid or unenforceable by any jurisdiction or government agency having jurisdiction, that particular provision will be deemed modified to the extent necessary to make the provision valid and enforceable. The remaining provisions will remain in full force and effect.

The Customer agrees that UltimateWebTraffic.com shall not be liable for any modification, suspension or discontinuance of the Service. 

UltimateWebTraffic.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

SUBJECT TO APPLICABLE LAW, THE CUSTOMER EXPRESSLY UNDERSTANDS AND AGREES THAT ULTIMATEWEBTRAFFIC.COM AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF ULTIMATEWEBTRAFFIC.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED, OR OBTAINED, OR MESSAGES RECEIVED, OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

This Agreement is subject to change at any time without prior notice.

You, hereby, agree that by ordering any services from us, you have read and accepted all the terms and conditions above.
